1. Acceptance of Terms

Welcome to HeyJoy. By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes your acceptance of such changes.

2. Data Rights and Commercial Use

You acknowledge and agree to the commercialization of aggregated, non-identifiable data.

HeyJoy operates a commercial division known as Hey Data. We utilize user activity to generate the Pulse Dashboard, an analytics product sold to third-party entities, including but not limited to municipalities, non-profits, and corporate partners.

HIPAA Compliance

All data monetized via Hey Data is stripped of Personal Identifiable Information (PII) and processed in strict accordance with HIPAA standards to ensure users cannot be re-identified.

Internal Privacy

Internal access to individual user records is prohibited unless compelled by a valid legal subpoena. We do not sell your direct contact information to advertisers.

3. Account Inactivity and Purging

To maintain system integrity and data hygiene, we enforce strict retention policies regarding inactive accounts.

One-Year Rule: Any account that has not registered a successful login for a period of one (1) year will be considered abandoned.
Automatic Termination: Abandoned accounts are subject to automatic termination and permanent data purging. This process is irreversible.
Early Termination: Accounts may be purged sooner than one year upon receipt of a valid request from the account holder, an authorized legal representative, or an authorizing government agency.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You are prohibited from:

Using the Service to violate any local, state, national, or international law.
Attempting to reverse engineer, decompile, or scrape data from the Service (including the Pulse Dashboard).
Transmitting any viruses, malware, or destructive code.
Impersonating another person or entity.

5. Intellectual Property

The Service and its original content, features, and functionality (including "Hey Data" analytics and the "Pulse Dashboard" interface) are and will remain the exclusive property of HeyJoy and its licensors. The Service is protected by copyright, trademark, and other laws of the United States.

6. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis.

HeyJoy makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein. We do not guarantee that the Service will be uninterrupted, secure, or free from errors. Resource maps and listings are subject to change and may not always reflect real-time availability.

7. Limitation of Liability

To the fullest extent permitted by applicable law, HeyJoy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
